Occupational Health and Safety Direction Rescinded
March 2020
Appeal by Canadian Pacific Railway Company of Direction by Ministry of Labour. The direction was issued after the death of an employee.
Reasons for appeal of direction include:
- not reasonably practicable;
- compliance would create a new hazards;
- fails to meet appropriate levels of specificity;
- lack of competence and by delegated official; and
- breach of procedural fairness.
Appeal was successful and Occupational Health and Safety Tribunal Canada rescinded the direction.
